1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the RoadM8 platform, including our website and mobile applications (the “Platform”).

By accessing or using RoadM8, you agree to be bound by these Terms in accordance with the laws of Australia.

2. Our Services

RoadM8 is a technology platform that connects customers requiring towing, roadside assistance, accident recovery, and machinery transport services with independent third-party towing operators (“Service Providers”).

RoadM8 does not directly provide towing services. All services are performed by independent contractors.

3. Eligibility

You must be at least 18 years old to use the Platform.

By using RoadM8, you confirm that:

  • You have legal authority to request towing services
  • All information provided is accurate and complete
  • You comply with all applicable Australian laws

4. Booking & Payments

  • Pricing is displayed before booking confirmation.
  • Charges are calculated based on service type, vehicle type, distance, location, and applicable fees.
  • Payment is processed through secure digital payment systems.
  • A digital invoice will be issued upon job completion.
  • Cancellation fees may apply depending on timing and driver dispatch status.

All prices are inclusive of applicable GST unless otherwise stated.

5. OTP Verification & Vehicle Handover

RoadM8 uses OTP (One-Time Password) verification for secure pickup and drop-off confirmation.

Customers must provide the correct OTP to the driver to confirm vehicle handover.

RoadM8 is not responsible for disputes arising from incorrect OTP sharing.

6. Service Provider Responsibility

All towing and roadside services are performed by independent contractors.

RoadM8:

  • Does not control how services are performed
  • Does not guarantee specific response times
  • Is not liable for actions or omissions of third-party operators

However, we take reasonable steps to onboard verified and compliant operators.

7. User Responsibilities

You agree:

  • Not to misuse the Platform
  • Not to provide false information
  • Not to interfere with driver safety
  • Not to engage in unlawful activity

RoadM8 reserves the right to suspend or terminate accounts for misuse.

8. Cancellations & Refunds

Refunds may apply in cases including:

  • Service provider cancellation
  • Duplicate payments
  • Verified service failure

Refund timelines depend on your financial institution.

9. Limitation of Liability

To the extent permitted under Australian Consumer Law:

RoadM8 is not liable for:

  • Indirect or consequential loss
  • Vehicle damage caused by third-party operators
  • Delays due to traffic, weather, or emergencies

Nothing in these Terms excludes rights you are entitled to under Australian Consumer Law.

10. Privacy

Your use of RoadM8 is also governed by our Privacy Policy.

We collect and use personal information in accordance with Australian privacy regulations.

11. Intellectual Property

All content, branding, software, and design associated with RoadM8 remain the intellectual property of RoadM8 and may not be copied or reproduced without written permission.

12. Modifications

RoadM8 may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of Australia.

Any disputes will be subject to the jurisdiction of Australian courts.
